CUSTOMER RATINGS AND REVIEWS TERMS OF USE

These Terms of Use govern your conduct associated with the Customer Ratings and Reviews and/or Questions and Answers service offered by UNIQLO (the "CRR Service").

By submitting any content to UNIQLO, you guarantee that:

-You are the sole author and owner of the intellectual property rights in the content;
-All "moral rights" that you may have in such content have been voluntarily waived by you;
-All content that you post is accurate;
-You are at least 18 years old;
-Use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity.

You further agree that you may not submit any content:

-That is known by you to be false, inaccurate or misleading;
-That infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;
-That violates any law, statute, ordinance or regulation (including, but not limited to, those governing, consumer protection, unfair competition, anti-discrimination or false advertising);
-That is, or may reasonably be considered to be, defamatory, libellous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;
-For which you were compensated or granted any consideration by any third party;
-That includes any information that references other websites, addresses, email addresses, contact information or phone numbers;
-That contains any computer viruses, worms or other potentially damaging computer programs or files.

You agree to indemnify and hold UNIQLO (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers, including but not limited to Bazaarvoice, Inc.), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys' fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law or the rights of a third party.

For any content that you submit, you grant UNIQLO a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.

All content that you submit may be used at UNIQLO's sole discretion. UNIQLO reserves the right to change, condense, withhold publication, remove or delete any content on UNIQLO's website that UNIQLO deems, in its sole discretion, to violate the content guidelines or any other provision of these Terms of Use. UNIQLO does not guarantee that you will have any recourse through UNIQLO to edit or delete any content you have submitted. Ratings and written comments are generally posted within two to four business days. However, UNIQLO reserves the right to remove or to refuse to post any submission to the extent authorized by law. You acknowledge that you, not UNIQLO, are responsible for the contents of your submission. None of the content that you submit shall be subject to any obligation of confidence on the part of UNIQLO, its agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees.


 

UNIQLO PRODUCT SAMPLING PROGRAM - TERMS AND CONDITIONS

  1. 1. This Product Sampling Program (“Program”) is organised by UNIQLO Australia Pty Ltd (ABN 36 161 922 103) of Level 19, Wesley Place, 150 Lonsdale Street, Melbourne, Victoria 3000  (“Promoter”).

  2. 2. When you (“Entrant” and “You”) submit an entry or otherwise participate in this Program, you confirm that you have read and understood, and agreed to comply with, the following conditions of entry contained herein, including how to enter, our Privacy Policy and our Terms of Use (see links below) (together, the “Terms and Conditions”).

  3. 3. At UNIQLO we are committed to evolving our clothing to make life better for you. That is our unique LifeWear philosophy. By participating in this Program, you’ll help us achieve our unique LifeWear philosophy.

  4. 4. The Program commences when the Program post is live on the Promoter’s website at www.uniqlo.com.au on May 1st, 2024 and concludes at 11.59pm (AEST) on May 31st, 2024 when the Program post in no longer available on the Promoter’s website at www.uniqlo.com.au (“Program Period”).

  5. 5. Entry to the Program is only open to permanent residents of Australia aged 18 years or older (“Eligible Entrants”). The Promoter may in its discretion refuse to award any product sample to any Eligible Entrant who fails to comply with these Terms and Conditions.

  6. 6. To submit an entry, Eligible Entrants must during the Program Period:

    1. a. Be a UNIQLO member and log in to the UNIQLO online store at www.uniqlo.com.au or via the UNIQLO AU App

    2. b. Submit a written review of a UNIQLO product via the ‘Write a Review’ portal accessible on the UNIQLO product description page or via your ‘Purchase History’. The Program is free to participate and no purchase is necessary.

  7. 7. By submitting a review, Eligible Entrants will be automatically entered into the Promoter’s Program where selected winners will receive a free UNIQLO product. If an Eligible Entrant wishes to opt out of the Program, they can click on the below link and provide requested details.

  1. 8. The Total Maximum Prize pool will not exceed $299.00. All monetary figures in these Terms and Conditions are in Australian dollars, inclusive of GST and based on the recommended retail value at the time of printing. The Promoter accepts no responsibility for any variation in the value of the prizes.

  2. 9. Ten (10) winners will be chosen by a random draw performed by a computerized process on a monthly basis and will receive one (1) free sample product (“Prize”) from the Promoter.

  3. 10. The Promoter will notify the winners by email (using the email linked to their member account) and to claim their Prize, winners must respond to the Promoter’s email within 7 days with their details including but not limited to: full name, Australian delivery address, phone number and preferred size / colour. The Promoter will arrange delivery of the prize to the winner’s supplied Australian delivery address. If a winner does not respond to the Promoter within 7 days of being notified by the Promoter, the Prize shall be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.

  4. 11. The Prize is non-exchangeable, non-transferrable and no cash alternative is offered. The Promoter reserves the right to replace the Prize with an alternative of equal or higher value if circumstances beyond the Promoter’s control make it necessary to do so. The Promotor takes no responsibility if the winning Eligible Entrant’s preferred style, size or colour is unavailable.

  5. 12. Written reviews can either be positive or negative and must be the Eligible Entrant’s honest opinion.

  6. 13. There is no limit as to the number of times an Eligible Entrant may enter this Program, however the Eligible Entrant shall only submit one written review per UNIQLO product.

  7. 14. The Promoter reserves the right to verify the validity of entries and the Eligible Entrants (including identity, age and place of residence) and to disqualify any entry which, in the opinion of the Promoter, includes or is objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any Eligible Entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Program and/or the Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry are of a type described in this clause. The Promoter may remove or delete any entry without notice for any reason whatsoever.

  8. 15. Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, or of any agencies their immediate families, and any agencies, retailers and suppliers directly associated with this Program are ineligible to enter the Program.

  9. 16.Entries must be free from claims that they infringe on any third party rights and cannot be submitted on behalf of any other person. Eligible Entrants warrant and agree that they will not submit any entry that includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, is unlawful or fraudulent, or could reasonably considered to be in breach of any intellectual property, privacy, publicity or other rights or otherwise unsuitable for publication. 

  10. 17. Entries not completed in accordance with these Terms and Conditions or are incomprehensible or incomplete will not be valid and will not be included in the Program.

  11. 18. Entries will be deemed to be accepted at the time the entry is received only by the Promoter, via its servers and not at the time of transmission by the Eligible Entrant. The Promoter accepts no responsibility for any entries not received by the Promoter, delays or disruptions in the delivery of the entries, or other matters that may interfere with an entrant’s ability to participate in the Program due to technical disruptions, network congestion or for any other reason.

  12. 19. All entries become the property of the Promoter (including any intellectual property rights contained therein). The name and entry of the winner may be published on the Promoter’s website and social media pages and in any promotional material that we consider relevant. Eligible Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Program. The personal information of the winner may be provided to others assisting in the conduct of the Program. All personal information provided to the Promoter will handled in accordance with the Promoter’s Privacy Policy.

  13. 20. The Eligible Entrant’s personal details may be used for marketing purposes of the Promoter only if the Eligible Entrant has opted in to receiving future marketing mailings from the Promoter or for any other purpose agreed by the Eligible Entrant. If an Eligible Entrant would like to stop receiving messages from the Promoter, he/she can use the below link and enter their email address under ‘Unsubscribe’.

  1. 21. The Program is not valid in conjunction with any other offer from the Promoter.

  2. 22. Promoter shall not be liable for any costs, loss or damage whatsoever which is incurred or suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a consequence of your participation in the Program, including collecting the Prize, any lost, late or misdirected entries, anything in connection with your use or misuse of any Prize, except for any liability which cannot be excluded by law. Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).  Once Prizes have been issued by the Promoter’s systems, the Promoter and their associated agencies take no responsibility for damaged, delayed or lost Prizes.

  3. 23. Unless expressly stated in these Terms and Conditions, all costs and expenses associated with the Prizes distributed pursuant to this Program are the responsibility of the Eligible Entrant.

  4. 24. If for any reason, this Program is not capable of running as planned, the Promoter reserves the right, in its sole and absolute discretion, to take any action that may be available and to cancel, terminate, modify or suspend the Program in whole or in part, subject to the approval of the relevant gaming authorities if required.  If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations. 

  5. 25. These Terms and Conditions constitute the entire terms and conditions between each Entrant and the Promoter with respect to the Program. The Promoter may alter, modify, or amend these Terms and Conditions at its discretion. 

  6. 26. The Promoter’s decision in relation to any aspect of the Program (including disputes concerning the conduct of the program and disqualification of any entry) is final and binding on each entrant and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
